Information on the processing of personal data during the application process

General information 

The following data protection declaration refers exclusively to the data transmitted and collected during the application process and gives you an overview of how we handle your personal data during the application process. 

To ensure that you are fully informed about the processing of your personal data within the application process, we ask you to read the following information carefully.

2. Purposes and basis of processing

We process your personal data in accordance with the provisions of the European General Data Protection Regulation (GDPR) and the Federal Data Protection Act (BDSG), insofar as this is necessary for the decision to conclude an employment relationship with us. The legal basis for this is Article 88 GDPR in conjunction with Article 26 BDSG-neu as well as Article 6(1)(b) GDPR for the initiation or implementation of contractual relationships, if applicable.


In addition, your personal data may be processed if this is necessary to fulfil legal obligations (Article 6(1)(c) GDPR) or to defend against legal claims made against us. The legal basis for this is Article 6(1)(f) GDPR. The legitimate interest is, for example, a burden of proof in proceedings under the General Equal Treatment Act (AGG). If you give us your express consent to process personal data for specific purposes, the lawfulness of this processing on the basis of your consent is given in accordance with Article 6(1)(a) GDPR. You may revoke your consent at any time, with effect for the future. 


Should an employment relationship arise between you and us we may, pursuant to Article 88 GDPR in conjunction with Article 26 BDSG-neu, process the personal data you have provided for the purposes of the employment relationship, if this is necessary for the fulfilment or termination of the employment relationship or for the execution or fulfillment of the rights and obligations of employee representation arising from a law or other applicable agreements.


3. Categories of personal data within the application process

We only process such data that are related to your application. Personal data is defined as data with which you can be personally identified.


Collected data:

  • First name, last name
  • Contact details (e-mail address, telephone number)
  • CV
  • Xing or LinkedIn profile (optional)


You also have the possibility to send us other relevant documents, such as a letter of motivation, qualifications, certificates or diplomas, which can contain further personal data such as your name, address or birthdate.


4. Processing of the data

Within our company, we only forward your personal data to employees in the personnel department or to employees involved in the application process who need this data to fulfil contractual and legal obligations or to protect our legitimate interests.


5. Duration of storage

Your personal data or application documents will only be stored until a decision has been made on your application, but for no more than six months after completion of the application process, unless a longer storage is legally required or permitted. Beyond that, we will only store your personal data as far as this is required by law or in a specific case to enforce, exercise or defend legal claims for the duration of a legal dispute.


In addition, we reserve the right to store your data in our internal "Talent Pool" for 365 days after the application process is completed in order to find other potentially relevant vacancies for you. For this purpose, we will request a separate consent from you.


If you have agreed to a longer storage of your personal data, we will store it on the basis of your declaration of consent.


After the storage period has expired, the data will be available to us anonymously and without direct personal reference for statistical analysis, e.g. to show the number of applications for a certain period. 


If the application process is completed and you are offered a job, apprenticeship or internship, your data will continue to be stored, if necessary and permissible, and then transferred to the personnel file. After termination of the employment contract, your personal data and documents may be stored for up to 10 years after termination of the employment contract.


6. Disclosure of data 

The data submitted in the context of your application will be transmitted to our database via TLS encryption and stored there. The database is provided by Pipedrive (https://www.pipedrive.com/en/privacy). Pipedrive is, in this context, our data  processor according to Article 28 GDPR. The basis for the processing is a contract for data processing between us as the responsible party and Pipedrive. 


We do not transfer data to third countries and there are no plans to do so.


7. Rights of data subjects

You have the right to access, rectify, and delete data, and restrict processing, as well as the right to data transferability.


8. Right of revocation

You have the right to revoke the consent you have given at any time, without this affecting the lawfulness of the processing carried out on the basis of the consent given until your revocation.


9. Right of objection 

Insofar as the processing of your personal data pursuant to Article 6(1)(f) GDPR is carried out to safeguard legitimate interests, you have the right pursuant to Article 21 GDPR to object to the processing of such data at any time for reasons arising from your particular situation. We will then no longer process this personal data unless we can prove compelling reasons for processing worthy of protection. These must outweigh your interests, rights and freedoms, or the processing must serve to enforce, exercise or defend legal claims.


10. Right to file complaints with regulatory authorities

11. Automated decision making

There is no automated decision making.


12. Providing your personal data and the consequences of not providing it

The provision of your personal data is voluntary; nevertheless, your application data is necessary for the realization of the recruitment process, i.e. without complete information, participation in the selection process is not possible.


13. Changes 

We reserve the right to modify this data protection declaration according to new circumstances and changed conditions (of a legal or actual nature).
